In these Jobseeker Terms the following expressions have the defined meanings:
"Application" means an application for a job vacancy that has been advertised on the Website;
"Jobseeker" means the person using the Website to search for jobs;

We try to ensure continuous availability of the site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may, additionally, alter the design and specification of the site at any time.
The Jobseeker acknowledges that we are not responsible for the content of any job vacancy advertising and that accordingly it is a matter for the Jobseeker to satisfy themselves as to the suitability of the job vacancy and the identity of the advertiser/recruiter.
5.1 If the Jobseeker submits an Application, the Jobseeker agrees that:
5.1.1 The Jobseeker has read and understood the requirements for the job vacancy;
5.1.2 If the Jobseeker submits any information in an Application that is found to be false, we reserve the right to deny the Jobseeker access to the Site and its services.
5.1.3 The Jobseeker should note that Applications are assessed by the relevant recruiter and all decisions relating to such Applications are taken by the relevant recruiter and not by us. Accordingly, any requests for information relating to Applications that have been made should be addressed to the recruiter directly.
The Website does not discriminate against anyone registered to or using the website. We try to ensure that all possible measures are taken to prevent any vacancies advertised or searches do not discriminate against age, disabilities, gender or race. The search tools in place on the site do not have the functionality to exclude any Jobseeker with disabilities. It is down to the users themselves to ensure they comply with discrimination laws.
Services and information provided on the Website by us and our third party suppliers are intended to assist Jobseekers in searching for jobs or any recruitment process. Neither we nor our third party suppliers can guarantee your suitability or prospects of success in any particular case. Jobseekers should obtain independent verification before relying on information provided on the Website in circumstances which may result in loss or damage.
Our liability and the liability of our third party suppliers, for any loss or damage suffered by the Jobseeker as the result of your use of this Website is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.
9.1 The Jobseeker understands and acknowledges that they have no ownership rights in their account and that if they cancel their account or their account is terminated, all their account information from the Website, including CVs, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted and may be deleted from the Websites databases within a reasonable time period. Third parties may retain saved copies of information.
9.2 We reserve the right to delete a Jobseekers account and all of their information after a significant duration of inactivity or in the event that any of our terms have been breached by the Jobseeker.
9.3 By registering their CV on the Website the Jobseeker agrees that we may also store and show their CV and profile details to recruiters, using the Website to search for Jobseekers.
9.4 By applying for a job through the website the Jobseeker agrees that the Website can store their CV and basic information (email address, email address, first name, last name and telephone number ) without them registering on the Website.
9.6 The Jobseeker acknowledges and agrees that they are solely responsible for the form, content and accuracy of any CV or material contained therein placed by the Jobseeker on the Website.
These Recruiter / Advertiser Terms and Conditions ("Recruiter Terms") are deemed accepted by the Recruiter when any Services are ordered by the Recruiter.
In these Recruiter / Advertiser Terms the following terms shall have the following meanings:
"CV" means the curriculum vitae of the Jobseeker that is prepared and supplied by a Jobseeker;
"Fees" means the sums payable by the Recruiter to the Website for the supply of the Services;
"Jobseeker" means a person who uses the Website to search and apply for job opportunities;
"Online Service" means the selection of the products listed in the Recruiter section of the Website.
"Recruiter" means the person, company or firm named on the Order Form;
"Recruiter Content" means all or any part of the content and materials (including job advertisement particulars) supplied or made available by the Recruiter in connection with the Services;
"Services" means all products (Advertising, Job Advertising and CV Database) available for use on the Website; "Website" means www.uktemps.co.uk;
2.1 Subject to these Recruiter / Advertiser Terms and in consideration of the payment of the Fees by the Recruiter, the Company shall provide the Services to the Recruiter during the Service Duration.
2.2 The Website shall endeavour to maintain its provision of the Services but the Website makes no guarantee that the Services will be uninterrupted or error free.
2.3 The Website shall be entitled to temporarily suspend or alter the operation of the Services for legal or technical reasons. The Website shall endeavour to notify the Recruiter as far in advance as possible of any temporary suspension or significant alteration but the Recruiter acknowledges that prior notice may not always be possible.
2.4 The Recruiter may request the removal of a job advertisement from the Website before the end of the job advertisements duration but shall not be entitled to any refund of Fees.
2.5 If any quota of job advertisements is not used up by the Recruiter within the Service Duration then the quota will expire and the Recruiter shall not be entitled to a refund of Fees.
2.6 The Website partners with Paypal for all online payments. Job advertisements purchased via our online service will only be posted after Paypal confirms that the transaction has been successful.
2.7 If the Recruiter uses a third party job posting service or has a bespoke posting method with the Website then a tailored invoicing process will be agreed between the Website and the Recruiter.
2.8 The Recruiter undertakes and warrants that its use of the Services and all Recruiter content (including, without limitation, job advertisements) comply with all applicable laws and codes of practice and shall not be defamatory, discriminatory or otherwise objectionable and shall not infringe any copyright, trade mark or other rights of any third party.
3.1 The Recruiters job advertisements will:
3.1.1 Be accurate, honest and truthful;
3.1.2 Not contain unnecessarily repeated words or phrases intended to cause a false positioning in the search results seen by a Jobseeker;
3.1.3 Not contain links away from the Website to any other website or any third party.
3.1.4 Not promote any ‘get rich quick’, pyramid selling or network marketing opportunities or similar.
3.1.5 Not charge the Jobseeker for any application or application process.
3.2 Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. Advertisements are accepted by the Website on the basis that the advertiser confirms that any requirement or qualification which may appear to discriminate illegally is in compliance with any exemption available under the relevant legislation. Notwithstanding this confirmation, if we nonetheless believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from the Website without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.
3.3 We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.
3.4 Job advertisements that you post on the Website may also appear on third party recruitment websites.
3.5 You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring the Website into disrepute. You will indemnify us from and against any claim brought by an individual against the Website arising from your breach of this obligation or any other of these terms and conditions.
4.1 This clause sets out the entire financial liability of Niffi Ltd to the Recruiter in respect of:
4.1.1 Any use made by the Recruiter of the Services;
4.2 Nothing shall exclude or limit Niffi Ltd’s liability for death or personal injury resulting from the negligence of Niffi Ltd or for fraud or for any other liability that cannot be excluded or limited by law.
4.3 Niffi Ltd has no liability to verify the identity of any Jobseekers or check the suitability of any Jobseekers for any job vacancy.
4.4 Niffi Ltd shall not be liable to the Recruiter for any loss of business, contracts, profits, anticipated savings, data, damage to hardware and software, or for any indirect, special or consequential loss.
4.5 Niffi Ltd does not accept liability for loss of any Recruiter Content.
4.6 Niffi Ltd’s liability in respect of any failure to perform the Services shall be limited to the re-performance of the relevant part of the Services as far as is practicable.
4.7 The total liability of Niffi Ltd to the Recruiter in respect of any loss or damage under or in connection with the Contract shall not exceed the aggregate amount of Fees paid by the Recruiter in the twelve months immediately preceding the incurring of such loss or damage.
5.1 Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to Niffi Ltd. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.
5.2 Use of the database
5.2.1 The Recruiter shall only use CVs and personally identifiable Jobseeker information for the purpose of finding employment for Jobseekers.
5.2.2 The Recruiter will not supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.
5.2.3 The Recruiter will not download the database through any automated process.
5.2.4 The Recruiter shall comply with the provisions of the Data Protection Act 1998 and, in particular, shall take all appropriate technical, organisational and security measures to prevent unauthorised access, loss and use of personal data relating to Jobseekers.
5.2.5 The Recruiter will only access our candidate database from a system that is safe to do so and has industry standard AntiVirus software installed that is regularly updated.
5.2.6 The Recruiter is responsible for satisfying itself as to the relevance of the Jobseeker for a job vacancy and verifying the identity of such Jobseekers.
5.2.7 The Recruiter agrees to deal fairly and professionally with individuals you contact using information from the Website candidate database and the Recruiter will not do anything which may bring the Website into disrepute. The Recruiter will indemnify Niffi Ltd from and against any claim brought by an individual against Niffi Ltd arising from your breach of this obligation or any other of these terms and conditions.
6.1 Fees for posting adverts onto the Website will be clearly shown at the time you post your advert. Fees are quoted in Pounds Sterling and they may be liable to change them from time to time at the Websites discretion. We will notify you of changes to our fees by advertising any changes on the Website. We may choose to have promotional events on the Website and such events may have a different fee. This different fee will advertised on the Website.
6.2 Any discounts agreed are confidential and may not be disclosed by the Recruiter.
6.3 A job on the Website is live for 30 days. Any extension of this time will be charged to the Recruiter as a new posting.
6.4 Where the Recruiter uses a third party job posting service or has a bespoke posting method with the Website any jobs posted in addition to the agreed number of jobs per month will be charged at a price per job agreed with the Recruiter at the time of the contract negotiation. If no price has been negotiated, a flat fee of £14.99 per job will be charged for each job over the agreed number.
6.5 All prices exclude VAT.
6.6 The Website does not accept payment by Maestro card.
